GENERAL

1. The promoter of The Yell Mentoring Works Awards 2008 (“Competition”) is Horsesmouth, 10 Golden Square, London W1F9JA (“Promoter” or “Horsesmouth”)

2. The sponsor of the Competition is YELL LIMITED, Queens Walk, Reading, Berkshire, RG1 7PT, United Kingdom ("Sponsor" or “Yell”).

3. No purchase necessary to enter. To be eligible to enter, a mentor must be nominated by a member of the public (“Nominator”) and accept the nomination as set out in section 4 below. This competition is open to residents aged 16 or over of mainland UK, Northern Ireland and the Isle of Man. Employees of Horsesmouth, Yell or any other companies associated with this competition and in each case their immediate families are not eligible to enter this competition.

4. The Competition starts at 12.00 PM on Sunday 27th July, and closes at 12.00pm (noon) on Friday 28th November 2008. Competition winners will be announced on the Website by 12th December 2008.

5. Entry process:

a. To nominate a person (“Nominee”) to receive a mentor award (“Nomination”) a Nominator must use the application forms available on the Website www.horsesmouth.co.uk [http://www.horsesmouth.co.uk/]
b. Once a Nomination is received, the Promoter will notify the Nominee of the Nomination by email;
c. Nominators may nominate more than one mentor as a Nominee for an Award. A mentor may also receive multiple Nominations; however an Entrant may only win one prize.
d. If shortlisted, a nominee will be asked to accept their Nomination. There is no obligation for a Nominee to accept the Nomination to enter the Competition, if a Nominee does not accept if shortlisted the Nomination will be discarded. To accept a Nomination a Nominee must register for an account or have an account on the Website 
e. Once the Nominee has accepted the Nomination, the Nominee will be entered into the Competition as an entrant (“Entrant”). The Promoter will notify the Entrant and the Nominator of the successful Competition entry;
f. The Promoter and Sponsor reserve the right to include Entrants in the Competition who have not been nominated by members of the public but whom the Judges feel are excellent examples of mentoring and deserving of recognition and reward;
g. Entrants will be subject to judging according to the judging criteria.
6. The Promoter will use its reasonable endeavours to notify the winners by telephone and/or by e-mail by 12th December 2008. Winners will be required to confirm within 14 days of notification that they wish to take their prize. In the event that a prize winner fails to confirm as instructed that they wish to take the prize or if at any point the Promoter discovers that their entry was invalid then the Promoter reserves the right to disqualify such person from the Promotion.

7. The Judge's decision is final in all respects. No correspondence will be entered into.

8. The winner of the Yell Small Business Mentor of the Year Award will receive a cheque for £1000, a certificate and an invitation to a Business Breakfast in December 2008 with a Business Hero. The two runners-up for the Yell Small Business Mentor of the Year Award, the winner of the Editor’s Prize and the winner of the M-factor Award will receive a certificate and invitation to a Business Breakfast in December with a Business Hero.

9. Prizes are non-negotiable, non-transferable and non-refundable. No cash alternative is available. Winners may be required to submit valid identification before receiving their prize. In the event of unforeseen circumstances the Promoter reserves the right to offer an alternative prize of similar value. The Promoter also reserves the right to vary these terms and conditions as necessary due to unforeseen circumstances.

10. The Promoter and Sponsor can accept no responsibility for entries that are lost, delayed or damaged. Proof of sending an email or entry by post is not proof of receipt of an Entrant’s details.

11. In making a Nomination or accepting such Nomination the Entrant and the Nominator consent to the Promoter and Sponsor processing their personal data for the administration of this Competition and in accordance with the Promoter’s privacy policy which is attached at Appendix A, and found on the website www.horsesmouth.co.uk and which is hereby incorporated into these terms and conditions.

12. In making the Nomination or accepting such Nomination the Entrant and the Nominator authorise the use of the information contained in the Nomination for promotional purposes in relation to the Competition in perpetuity by any and all means in any and all media, including for online, television, publication and exhibition uses. The Entrant and Nominator grant to the Promoter and Sponsor the right to issue publicity concerning the Competition featuring their details and agree to being used as a case study in local and national media and to take part in media interviews if required. All Nominators and Entrants hereby agree to make themselves available for such purposes.

13. The Competition winner’s name and county will be made available by sending a SAE to The Editor, Horsesmouth, 10 Golden Square, London W1F9JA, within [60] days of the Closing Date.

14. These terms and conditions are governed by and construed and performed in accordance with the laws of England and Wales, whose courts shall be the courts of exclusive jurisdiction.


THE YELL MENTORING WORKS AWARDS (“Awards”)

15. There are three categories of Awards as follows.

AWARD A -  The Yell Small Business Mentor Of The Year
This is awarded to the person judged as the Best Small Business Mentor of 2008, by way of adjudicated Nominations.Entrants may be users of Horsesmouth or members of the general public. The Award is judged by a panel, chaired by Horsesmouth and Yell, with set criteria. It will be judged from Nominations.The winner will receive a certificate, a cheque for £1000 and an invitation to a Business Breakfast in December with a Business Hero.Two runners up will receive a certificate and an invitation to a Business Breakfast in December with a Business Hero.The winner and runners up will be able to choose a Business Hero to meet, from a list developed & provided by Horsesmouth.


AWARD B- The Editor’s Prize for Mentoring
This is Awarded to the best business or enterprise story or pearl of wisdom published on Horsesmouth, as submitted to the Awards. This Award is judged solely at the discretion of the Editor of Horsesmouth, from Nominations. The winner will receive a certificate and an invitation to a Business Breakfast in December with a Business Hero. The winner will be able to choose a Business Hero to meet, from a list developed & provided by Horsesmouth. The Editor’s criteria includes the power of the story, the impact on those involved & the mentoring success.

AWARD C -  The Horsesmouth M-Factor Award - Sponsored By Yell
The M-Factor Award cannot be nominated. It will be awarded to the business or enterprise mentor on Horsesmouth with the highest M-Factor rating. The M-Factor Rating is the mentoring user rating system contained upon the Website. It will be awarded at the discretion of the Editor of Horsesmouth.
The winner will receive a certificate and an invitation to a Business Breakfast in December with a Business Hero. The winner will be able to choose a Business Hero to meet, from a list developed & provided by Horsesmouth

THE JUDGING PANEL AND JUDGING CRITERIA

16. All Entrants will be subject to a formal process of adjudication and the full decisions and rationale for selection will be published on the Website. Those Entrants who are short listed for final judging (for Awards A, C and D) will be contacted and interviewed by phone to support their Nomination and they may be asked to give further evidence of their mentoring as detailed in the Nomination.

17. The Editor’s Prize for Mentoring (Award A): The Editor of Horsesmouth (“Editor”) will select the mentoring story that in their opinion, best exemplifies the spirit and power of mentoring and is related to the topic of business and enterprise. Criteria the Editor will use to select the winner shall include; usefulness of story, presentation of both problem and solution, quality and colourfulness of writing and the importance of the piece of content to the topic of business and enterprise.

18. The Horsesmouth M-Factor Award (Award B): The Website features its own automated rating system for mentoring (The M-Factor) that is set by site members. It is not possible to nominate for this Award. The five mentors on Horsesmouth with the highest M-factor rating will be displayed on the competition page. The Editor will award this prize to the mentor with the highest M-factor who has provided mentoring in the area of business and enterprise.

19. Yell Business Mentor of The Year (Award C): The judging panel will be chaired by the founder of Horsesmouth and the panel shall include the Editor, three management representatives from Yell and three independent judges from independent business and Enterprise. The criteria the panel shall use for selecting the winner will include; friendliness, timeliness, helpfulness.


APPENDIX A 

PRIVACY POLICY – HORSESMOUTH

Here at horsesmouth we take your privacy extremely seriously, and are committed to providing a safe and private online environment for the services we provide. Generally, any information you provide us with is kept in confidence unless you agree to publish it. We do not sell, rent, share, or otherwise disclose personally identifiable information with any other parties, including other users of our website. We only intend to provide our services to people over the age of 16. We do not knowingly collect personal data from children without parental consent. This privacy policy sets out the terms by which we hold and process any such personal data received.

We reserve the right to change our privacy policy. We will normally post details of any changes on our website at least 7 days before the changes take effect, unless urgent circumstances require us to change the policy immediately.
 
Who we are

Under the Data Protection Act 1998, Horse’s Mouth is known as a 'Data Controller'.  In simple terms, this means that we determine what personal information about you is collected and how it will be used.
In this privacy policy references to 'the Data Controller', 'we', 'us' and 'our' are to Horse’s Mouth Foundation; references to 'our Website' or 'the Website' are to www.horsesmouth.co.uk; references to 'the Services' are to the services offered in the Website, namely:
 –a search engine matching people who require information and guidance with profiled people who have 'been there, done that';
–hosting of moderated online dialogue between users;
–linking to professional organisations,
–a user-driven reputation system;
–mentoring offered by users or other individuals who agree to give their time and share their experiences to help and benefit others.

Collection of information

In the course of providing the services we will need to collect, use and retain personal information such as your name, address, mobile telephone number, email address, IP address (i.e. a string of numbers unique to your computer that is recorded by the Website when you request any page or component) and other pertinent details; monitor your usage of the Website; host the emails or other communications you exchange by the Website with other users of the same Website.
 
Under the Data Protection Act 1998, information which relates to an individual’s political opinions, racial or ethnic origins, mental or physical health, sexual life, religious persuasion, trade union affiliation or criminal records are defined as 'sensitive personal data'. You do not need to disclose any sensitive personal data to us for us to provide the Services. However, if you choose to make reference to or disclose any sensitive personal data in emails or other communications hosted by the website, you are giving your consent to us collecting and processing this data to provide the services.
 
We collect personal information directly from you, subject to receiving all necessary authorisations from you. This is done with your consent. Your personal data will not be disclosed to any third party, government institution or authority unless required by law or in exceptional circumstances we consider it necessary and appropriate to protect someone from suffering serious harm or injury, in which case we may pass on your data to an appropriate and responsible third party. You consent to use using any personal data that you provide, including any sensitive personal data that you provide, in this way.
 
In addition we process personal data to carry out statistical analysis of site usage and provide you with more relevant or customised services. We may also use this statistical information for market research and/or advertising purposes. We may share it with third parties (but no individual will be identifiable from data shared with third parties for these purposes.)
 
Although we encourage people using our website to remain anonymous and not disclose their identity to anyone else using the site, we moderate the website and can link information which you disclose in contributions you post on the website about your experiences with other personal data identifying you which we have obtained through the registration process. We only publish any of your Conversations with your agreement and in accordance with our Terms of Use. We will also protect your anonymity by not publishing or transferring any other personal data we hold which identifies you (such as your name or address).  However, we cannot be responsible for any breach of data protection legislation and principles if the content of your Conversations enable other people to identify you from how you describe your experiences and you have agreed to publish these Conversations.
 
Log data and cookies

'Cookies' are small data files that we send to your Internet browser, which are stored on your computer's hard-drive and subsequently read back if you visit the Website again. These cookies enable us to recognise you and any preferred technical settings you have, saving you from re-entering information on a return visit the Website. Confidentiality and security precautions

The Website has security measures in place to protect the loss, misuse and alteration of the information under our control. We have implemented security policies, rules and technical measures to protect the personal data that we have under our control from unauthorised access, improper use or disclosure, unauthorised modification and unlawful destruction or accidental loss.
All personal information provided is kept on a secure server and all employees and data processors who have access to, or are otherwise associated with, the processing of personal data, are obliged to respect the confidentiality of any personal data received.

Access to information

You have the right to find out what information we keep about you. To do this, please send us a written request to the address shown above. We will answer your request within 30 days, although we may require you to pay a £10 charge to cover administration costs. In this case, the 30-day period for processing your request will start after we receive this payment. To maintain security we may require proof of your identity. We allow you to challenge the accuracy of any data that we hold about you and, where appropriate, you may request that data we hold be corrected or deleted, as necessary.
